Kevin Kennedy said he needed to sleep off a hangover but when he did it Wednesday in an apartment that wasn't his, a real estate agent dialed 911, according to a Palm Beach County Sheriff's Office arrest report.
The real estate agent at Palm Beach Place on the 1400 block of Lake Crystal Drive in unincorporated West Palm Beach left and called security guards, who then called deputies. The real estate agent said she tried to lock the man inside, but he ran out to the pool about 300 feet away.
That's where a deputy found what he described as a very drunk and very nervous, soaking wet Kennedy, 32. The deputy said Kennedy first gave a fake name but a credit card in his pocket and a fingerprint scan uncovered his real identity.
Kennedy then explained he was drunk and just needed a place to sleep it off. He said his friend, whose name he didn't know, pried open the rear sliding door of another friend's apartment. Then he slept inside, according to the report.
The actual owner of the apartment lives in California and talked with the deputy over the phone and said she wanted to press charges.
A 16-ounce can of watermelon Four Loko in the bedroom where Kennedy had been sleeping was the only thing the deputy said he found in the apartment. Pry marks on the sliding door were found outside but the tool that made the marks was not.
Deputies discovered Kennedy's real address was about 200 feet north of the break-in and a records check found a warrant for his arrest.
He faces burglary, criminal mischief, fraud, failure to appear and probation violation charges and is being held in Palm Beach County Jail in lieu of $5,500 bail.
